By accessing or using https://circarhythm.com.au (the "Site") or purchasing a CircaRhythm product, you agree to be bound by these Terms of Service. Please read them carefully before using the Site.

1. General Conditions

We reserve the right to refuse service to anyone, at any time, for any lawful reason.

By using this Site, you confirm you are at least 18 years old, or are using the Site with the consent and supervision of a parent or guardian.

2. Products & Services

CircaRhythm products are designed to support circadian rhythm and sleep wellbeing for shift workers and people with irregular schedules. CircaRhythm products are not medical devices. They are not intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition, including insomnia, sleep disorders, jet lag, fatigue, or Shift Work Sleep Disorder. If you have a medical condition affecting your sleep, please consult a healthcare professional.

We make every effort to display product descriptions, images, and pricing accurately, but do not guarantee this content is complete, current, or error-free. We reserve the right to:

• Modify or discontinue products without notice
• Limit quantities purchased per customer
• Refuse or cancel orders at our discretion, including where we suspect fraud or error in pricing/stock

3. Alarm & Device Reliability

CircaRhythm devices rely on correct setup, power, and (where applicable) Wi-Fi/app connectivity. Power interruptions, incorrect settings, network issues, or software updates may occasionally prevent an alarm or light/sound sequence from operating as expected. If waking at a specific time is safety-critical for your role (e.g. shift work, medical, transport), we recommend using an independent backup alarm. We are not liable for consequences arising from a missed or delayed alarm.

4. Pricing & Payments

All prices are listed in Australian Dollars (AUD) unless otherwise stated, and include GST where applicable. We reserve the right to change pricing at any time without prior notice; the price charged is the price displayed at the time you complete checkout.

Payments are processed securely through third-party payment providers (including Shopify Payments and our nominated payment partners). We do not store complete payment card information on our own servers.

5. Shipping & Delivery

Delivery timeframes are estimates only and may vary depending on location, courier performance, and factors outside our control. We are not liable for delays caused by shipping carriers, customs authorities, or force majeure events, though we will assist you in resolving delivery issues where we reasonably can.

6. Returns & Refunds

Our 30-night guarantee and refund process are set out in our [Returns & Refunds Policy]. We reserve the right to decline a return or refund that doesn't meet the conditions in that policy, without limiting any right you have under the Australian Consumer Law.

7. Product Safety & Compliance

CircaRhythm devices are for indoor, domestic, adult use only and are not a toy — keep out of reach of children. Devices contain an internal, non-user-replaceable lithium button/coin battery; if swallowed or suspected swallowed, contact the Poisons Information Centre on 13 11 26 immediately. Full safety information, including operating conditions and cleaning instructions, is provided in the product manual supplied with your device. Do not open, modify, or attempt to repair the device — this voids the warranty and may create a safety risk.

8. Warranty

CircaRhythm products come with a 12-month warranty against defects from the date of purchase.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

This warranty is provided by Circa Rhythm and is in addition to, and does not limit or exclude, any other rights and remedies you have under the Australian Consumer Law.

• Warranty period: 12 months from the date of purchase
• To make a claim: contact us at support@circarhythm.com.au with your proof of purchase and a description (and, where possible, photos) of the fault
• What we'll do: assess the claim and, where it's covered, repair, replace, or refund the product at our discretion
• Costs: we will advise you of the process and any costs for returning the product to us at the time of your claim

Do not open, modify, or attempt to repair the device yourself — this voids this warranty and may create a safety risk.

9. Intellectual Property

All content on this Site — including text, graphics, logos, product images, videos, product descriptions, and the CircaRhythm™ brand and Light & Sound Reset Sequence™ positioning — is the property of Circa Rhythm or its licensors and may not be reproduced, copied, or distributed without our prior written permission.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law (ACL) or other applicable law. Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure doesn't amount to a major failure.

11. Prohibited Uses

You agree not to use the Site to:

• Engage in any unlawful purpose or activity
• Violate any applicable Commonwealth, state, or territory law or regulation
• Infringe our or any third party's intellectual property rights
• Distribute malicious software or harmful code
• Engage in fraudulent or deceptive conduct

12. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 10 above, we are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our products, services, or this Site. Nothing in this section limits any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

13. Privacy

Your personal information is handled in accordance with our [Privacy Policy].

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.

15. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page and updating the "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
